Abstract

Legal aspects of patents, EU vs US Laws and recent case law: The presentation will guide you through the legal pitfalls relating to intellectual property and the exploitation thereof. After a general introduction, ownership, challenges and enforceability of intellectual property rights will be discussed in view of recent case law. Furthermore, legal requirements in various European countries and the US will be compared to give you a broad overview. In addition, you will learn about additional regulatory protection mechanisms such as SPCs, orphan drug act and data exclusivity and how to use them in connection with intellectual property protection.

Carine van den Brink

Carine van den Brink combines 25 years of legal experience in life sciences with a medical background and in-depth knowledge of the biotech and technology markets. She specialises in intellectual property licensing, research and development driven contracts, pharmaceutical contracts, financing rounds and mergers and acquisitions. Carine guides her clients from the crib to their exit, including spinning out businesses from universities, obtaining financing (equity, loans, or subsidies), securing strategic partners, intellectual property exploitation, clinical development, market approval, and commercialisation.

Carine obtained a medical degree as well as a law degree. From 1990 until 1997 she worked for the Dutch law firm Stibbe and at the same time, held the office of registrar of the Dutch Medical Practitioners Disciplinary Tribunal. After leaving Stibbe, she worked as corporate counsellor for Pharming, the first biotechnology company in The Netherlands. After having worked as senior legal counsel for a listed ICT company, she started her own life sciences law firm. Carine’s clients include well-known European biotech companies, knowledge institutes, academic hospitals, and venture capitalists.

Carine holds a unique position at the intersection of law and biotechnology. She lectures at Leiden University, AMC/VU Summerschool, BioBusiness Masterclass and is a member of the Take Off committee financing of early stage life sciences starters. Because of her wide experience and expertise, Carine frequently functions as jury member for life sciences venture awards.
